Village court rules garland
Efforts to make the village court effective began in 1986. Following this, village court rules were issued in 2016. But so far the village court is not effective enough. The results of the UNDP and EU financial and technical assistance projects to activate village courts are encouraging. If small disputes cannot be resolved quickly and efficiently, that is what leads to large disputes and complex civil or criminal cases. The people of the village
Do not want to go to court easily. In many parts of the country, people are relying on community-based arbitration as an alternative to dispute resolution. Disputes are being resolved through police mediation in many places.
The village court consists of a panel of five headed by the chairman of the Union Parishad. Although the panel does not have a member of the Bangladesh Judicial Service Commission, the activities of the village court are under the administrative jurisdiction and supervision of the Supreme Court and the Chief Justice for two reasons. First, village courts exercise judicial power in Bangladesh. Second, Any order or judgment given by the village court has to be appealed to the Senior Assistant Judge and Senior Judicial Magistrate. So the village court is an integral part of the lower court. Its supervision should be vested in the District and Sessions Judge.
The village demanded the restructuring of the court structure. UP chairmen were elected party symbols. If the impartiality of the chairman in the management of the court is in question, the Upazila Nirbahi Officer can give remedy in the application of the parties. Officially, the chairman may change the way he plays the leading role in the court. The UNO will make a list of notable persons for each union and send it to the district judge. The District Judge will, if necessary, inquire from the Officer-in-Charge (Investigation) of the police station about the persons listed. Thus, on the recommendation of the district judge, the chief judge of the village court and four others will be appointed in consultation with him. The district judge can now take initiative under the existing law under the direction of the Chief Justice to activate the village court quickly. The first task will be to create such an impression in the minds of the people that the village court is under the supervision of the Bangladesh Supreme Court and a matter of special interest. In this context, an example of 2014 can be mentioned. A Chowki court in Habiganj's Ajmiriganj upazila noticed that about 600 cases were pending in the village courts of the concerned unions. The court began regular discussions and observations with the chairmen. Within a year, the number of cases dropped to six. Therefore, under the pressure of about 4 million pending cases, the dynamic and effective village court in the judiciary of Jabuthbu country can be a great reliance of the aggrieved people.
